1. ABOUT THE CURATED
These Terms & Conditions apply to purchases made from The Curated through our Australia & New Zealand online store.

In these Terms, “The Curated”, “we”, “us” and “our” refer to The Curated AS.
These Terms apply to customers purchasing as consumers.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified, including rights that may apply under the Australian Consumer Law or the New Zealand Consumer Guarantees Act 1993.
2. PRODUCTS & AVAILABILITY
All products are subject to availability. Adding a product to your shopping bag does not reserve it.
We may discontinue products, limit quantities, correct product information or errors, or refuse orders where reasonably necessary due to suspected fraud, abuse, unauthorised commercial resale or other legitimate reasons, subject to applicable law.
If a product becomes unavailable after you place an order and we cannot fulfil it, we will refund any applicable amount already paid.
3. PRODUCT INFORMATION
We take reasonable care to ensure that product descriptions, images, prices and other information displayed on our website are accurate.
Colours may appear differently depending on your screen or device. Natural materials may have reasonable variations in colour, texture and appearance.
Measurements are approximate and reasonable manufacturing tolerances may apply.
Nothing in this section affects your statutory rights where products are faulty, not as described, not of acceptable quality or otherwise fail to comply with applicable consumer guarantees.
4. ORDERS
Please review your order carefully before submitting it.
After an order is submitted, an order confirmation will normally be sent electronically to the email address provided at checkout.
Failure to receive an order confirmation does not by itself mean that an order was not received or concluded. If you do not receive an order confirmation, please contact Customer Care.
You are responsible for ensuring that the email address and other contact information provided with your order are complete and accurate. Please check your spam or junk folder if you do not receive an expected communication from us.
Subject to applicable law, we may cancel or reject an order because of:
- product unavailability;
- inability to verify or authorise payment;
- suspected fraud or unlawful activity;
- misuse of promotions or customer benefits;
- an obvious pricing or technical error;
- abusive ordering behaviour;
- suspected unauthorised commercial resale; or
- applicable delivery restrictions.
Where payment has already been collected for an order we cancel, the applicable amount will be refunded.
5. ELECTRONIC COMMUNICATIONS
Order confirmations, shipping confirmations, invoices, delivery updates, pre-order updates and other communications relating to your purchase may be provided electronically using the contact information supplied with your order.
The Curated is not responsible for a customer's failure to receive or review a communication where it was sent to the contact information provided by the customer, to the extent permitted by applicable law.
This does not affect mandatory consumer rights or any obligation of The Curated to provide information required by law.
6. PRICES, GST, DUTIES & TAXES
Prices on our Australia & New Zealand store are displayed in AUD, unless otherwise indicated at checkout.
If your payment method is denominated in another currency, your bank or payment provider may apply its own exchange rate or fees.
Applicable GST, customs duties and import charges for deliveries to Australia and New Zealand are included or prepaid by The Curated where stated at checkout.
No additional import duties should therefore be due upon delivery where those charges have been included or prepaid by The Curated.
Applicable shipping charges will be displayed before you complete your purchase.
We may change prices from time to time, but subsequent price changes will not affect a purchase already concluded.
If a product is displayed at an obviously incorrect price because of a genuine pricing or technical error, we may correct the error and, where permitted by applicable law, cancel the affected order and refund any payment made.
7. SALES, DISCOUNTS & PROMOTIONS
Sales, discounts and promotional offers are subject to applicable pricing and consumer-protection laws.
Promotional offers may be subject to additional conditions communicated with the relevant promotion.
Unless otherwise stated, promotional codes cannot be combined, have no cash value and may not be used for unauthorised commercial resale.
We may refuse, cancel or adjust a promotional benefit where reasonably necessary because of fraud, unlawful activity, misuse, circumvention of promotional conditions or an obvious technical error, subject to applicable law.
Any mandatory consumer rights continue to apply to sale and discounted products.
8. PAYMENT
Available payment methods are displayed at checkout.
By submitting payment details, you confirm that you are authorised to use the relevant payment method.
Payments may be processed by third-party payment providers and may be subject to security, verification and fraud-prevention checks.
9. PRE-ORDERS
Products available for pre-order will be clearly identified on the relevant product page.
The expected dispatch or delivery period displayed for a pre-order is an estimate unless expressly stated otherwise.
By purchasing a pre-order product, you acknowledge that the product is not available for immediate dispatch.
Production, freight, customs or other circumstances may affect expected timing. Where reasonably practicable, we will communicate material changes to the expected timing of your pre-order.
Payment may be collected in full when the pre-order is placed.
Our standard Returns & Refunds Policy applies to pre-orders. Any statutory consumer rights applicable to your purchase continue to apply.
Orders containing both available and pre-order products may be shipped separately.
10. DELIVERY
Available shipping methods, applicable charges and estimated delivery times are displayed on our website or at checkout.
Delivery times are estimates unless a delivery date has been expressly guaranteed.
You are responsible for providing complete and accurate delivery information.
Where permitted by applicable law, we may recover reasonable additional costs resulting from incorrect delivery information or an unreasonable refusal or failure to accept delivery.
Risk of loss or damage passes in accordance with applicable consumer law.
11. CHANGING OR CANCELLING AN ORDER
If you wish to change or cancel an order, please contact hello@shopthecurated.net as soon as possible.
We cannot guarantee that an order can be amended or cancelled once processing has begun.
Once an order has been dispatched, operational cancellation may no longer be possible.
This does not affect any statutory rights or remedies available to you under applicable consumer law.
12. CHANGE-OF-MIND RETURNS
The Curated offers change-of-mind returns in accordance with our Returns & Refunds Policy.
Unless applicable law provides otherwise, Australian and New Zealand consumers do not generally have an automatic statutory right to return a product solely because they have changed their mind. Our change-of-mind returns policy is an additional commercial benefit offered by The Curated.
Nothing in our change-of-mind policy affects statutory rights relating to faulty, damaged, incorrectly described or otherwise non-conforming products.
13. CONDITION OF RETURNED PRODUCTS
For change-of-mind returns, returned products should be:
- unworn other than for reasonable fitting;
- unwashed and unaltered;
- undamaged;
- free from stains, make-up, deodorant, fragrance, odours, pet hair or other marks or contamination;
- returned with original tags and security ribbons attached where supplied; and
- returned with accessories, garment bags and other components supplied with the product.
Products should be returned in their original packaging where reasonably possible.
If the original shipping box is no longer suitable, the product must be securely packaged in appropriate protective packaging to prevent damage during return transit.
Where inadequate packaging or handling causes damage to or diminishes the value of a product, we may make an appropriate deduction or decline a change-of-mind return to the extent permitted by applicable law and our Returns & Refunds Policy.
These conditions apply to our change-of-mind policy and do not restrict rights relating to products that fail to comply with applicable statutory consumer guarantees.
14. RETURN COSTS
For change-of-mind returns, customers are responsible for the direct cost of returning the goods in accordance with our Returns & Refunds Policy.
Where The Curated provides a prepaid return service, the applicable return fee may be deducted from your refund.
Different rules apply where a product is faulty, damaged, incorrect or otherwise fails to comply with applicable consumer guarantees.
Where The Curated is legally responsible for return costs, we will bear those costs as required by applicable law.
15. REFUNDS
Refunds will ordinarily be issued to the original payment method.
For ordinary change-of-mind returns, original outbound shipping charges are not refundable unless our Returns & Refunds Policy states otherwise or reimbursement is required by applicable law.
An applicable prepaid return fee may be deducted from a change-of-mind refund.
Once your return has been processed, your bank, card issuer or payment provider may require additional time for the refund to appear in your account.
Nothing in this section limits any refund or other remedy required under applicable consumer law.
16. AUSTRALIAN & NEW ZEALAND CONSUMER GUARANTEES
Consumers in Australia and New Zealand may have statutory rights relating to the quality, description, fitness for purpose, safety and durability of products.
For Australian consumers, these rights include consumer guarantees under the Australian Consumer Law. Australian consumer guarantees apply automatically and cannot be removed by store terms or warranties. Depending on whether a failure is major or minor, remedies can include repair, replacement or refund, and certain reasonably foreseeable losses may also be recoverable.
For New Zealand consumers, applicable rights may include guarantees under the Consumer Guarantees Act 1993, including requirements relating to acceptable quality, description and fitness for purpose and remedies where those guarantees are not met.
These statutory rights are separate from and additional to The Curated's voluntary change-of-mind Returns & Refunds Policy.
17. FAULTY OR NON-CONFORMING PRODUCTS
If you believe you have received a product that is faulty, damaged, incorrect or otherwise non-conforming, please contact Customer Care at hello@shopthecurated.net and include your order number and photographs where possible.
We may reasonably inspect or assess the product in order to determine the nature of the issue. This does not restrict any rights you have under applicable consumer law.
Where The Curated is legally responsible, we will provide the remedy required by applicable law and bear reasonable return costs where required.
Depending on the circumstances and applicable law, the appropriate remedy may include repair, replacement, refund or another remedy.
Damage resulting from normal wear and tear, accident, improper care or misuse is not considered a product fault where the issue was caused by that wear, accident, improper care or misuse.
Nothing in this section limits your rights under the Australian Consumer Law, New Zealand Consumer Guarantees Act or other mandatory applicable consumer law.
18. FAIR USE, FRAUD & ABUSE
We monitor transactions and returns to protect The Curated and our customers against fraud and misuse.
Subject to applicable law, we may refuse future transactions, restrict services, require additional verification, or suspend or close accounts where we reasonably identify:
- fraudulent activity;
- wardrobing;
- excessive or abnormal return activity indicating misuse;
- refund or chargeback abuse;
- promotion misuse;
- attempts to circumvent restrictions using multiple accounts;
- unauthorised commercial resale; or
- other material misuse of our services.
This does not affect statutory rights relating to purchases already made.
19. PRODUCTS PURCHASED ELSEWHERE
We can only process returns, refunds, exchanges and claims for products purchased directly from The Curated.
Products purchased from another retailer should be returned to or handled through the retailer from which they were purchased, subject to applicable law.
20. INTELLECTUAL PROPERTY
The website and its content, including trademarks, trade names, text, photographs, graphics, designs, video, audio and other materials, are owned by or licensed to The Curated and are protected by applicable intellectual-property laws.
You may use the website for personal, non-commercial purposes.
You may not reproduce, distribute, commercially exploit or otherwise use protected content without our permission except where permitted by law.
21. WEBSITE USE
You must not misuse the website, interfere with its operation or security, introduce malicious software, attempt unauthorised access, or use automated systems to extract website content in a manner prohibited by applicable law.
We may restrict access where reasonably necessary to protect the website, The Curated or other users.
22. THIRD-PARTY SERVICES
Our website may use or link to services provided by third parties, including payment, delivery and technology providers.
We are not responsible for independent third-party websites or services outside our reasonable control, except where applicable law provides otherwise.
23. LIABILITY
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified.
Subject to those rights and applicable law, we are not responsible for losses caused by your breach of these Terms or circumstances outside our reasonable control.
Any limitation or exclusion contained in these Terms applies only to the maximum extent permitted by applicable law.
24. CIRCUMSTANCES OUTSIDE OUR CONTROL
We are not responsible for delay or failure caused by circumstances outside our reasonable control to the extent permitted by applicable law.
These may include severe weather, natural disasters, transport disruption, strikes, customs disruption, governmental action, war, civil disturbance, telecommunications failures or other events we could not reasonably prevent.
This does not affect rights available to you under mandatory consumer law.
25. CHANGES TO THESE TERMS
We may update these Terms from time to time.
The Terms applicable to your purchase are those in effect when your contract with us is concluded.
A later change to these Terms will not retrospectively alter the terms governing an existing purchase unless required or permitted by law.
26. SEVERABILITY
If any provision of these Terms is found to be unlawful, invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
27. GOVERNING LAW & DISPUTES
These Terms and your contract with The Curated are governed by Norwegian law.
However, this choice of law does not exclude, restrict or modify mandatory consumer protections that apply to Australian or New Zealand consumers and cannot lawfully be excluded.
Nothing in these Terms prevents a consumer from exercising rights or remedies, or bringing proceedings, where permitted under applicable consumer law.
